Domestic Violence Maryland Assault Battery Lawyers Anne Arundel

ASSAULT & BATTERY/DOMESTIC VIOLENCE DEFENSE

Maryland Criminal Defense Lawyer

In Maryland, assault & battery is generally when one person touches or attempts to touch another without the consent of the person being touched or acting in a threatening manner, thereby causing another to be in fear of immediate harm.

Domestic Violence Maryland Assault Battery Lawyers Anne Arundel
Domestic Violence Maryland Assault Battery Lawyers Anne Arundel

In the past, assault was different from battery. Assault was the threat of an unwanted touching. Battery was the actual touching. Now, like most states, Maryland does not distinguish between the terms and the term assault & battery is used interchangeably.

Domestic violence is a form of assault and battery in Maryland. In Maryland, domestic violence is the assault & battery on a household member or family member by another household member. In the past, domestic violence was not paid a lot of attention to by the justice system in Maryland. Society viewed it as a family matter and deemed that the parties would resolve their differences without third party intervention. In the recent past, society’s attitude has changed towards domestic violence. The Maryland courts now treat domestic violence very seriously. The family member , who is usually the spouse in Maryland can no longer have the charges dropped by telling the prosecutor or the court that they do not wish the family member charged to be prosecuted. Once the police are called, usually the matter of whether the family member is prosecuted is no longer up to the alleged victim. A domestic assault charge is not a simple case in Maryland.

A number of factors will determine the punishment of the person who is convicted of domestic violence in Maryland. Some of the factors are the severity of the victim injuries, whether a minor was present (and even worse, if the minor saw the domestic violence or was a victim of the domestic violence) and lastly whether this is the first time the person has been convicted of domestic violence.

In Maryland, a third or subsequent offense of domestic violence can result with being convicted of a felony.

Most people do not realize that Maryland are starting to prosecute people accused of a sex crime with an attitude of no mercy.

In fact, even the local counties and cities in Maryland are starting up internet sex crimes task forces. Due to the worldwide presence of the web, a person who is accused of breaking a law regarding an internet sex crime can be prosecuted in an entirely different part of the state or even another state or country.

Each state has different laws regarding internet sex crimes. Additionally, the federal government also prosecutes internet sex crimes. Most jurisdictions in Maryland are now taking the position that if a person accused of an internet sex crime does not plead guilty to the charges as presented, then they will simply turn the case over to the Feds (federal government) for prosecution. The state governments are leveling this threat because they are aware that most attorneys are not willing to take on the federal government if it decides to prosecute a case. If you have been charged with a sex crime in federal court, you can count on our attorneys to defend you in federal court. We have the experience to defend you against any type of computer sex crime in federal court.

INTERNET CHILD PORNOGRAPHY (KIDDIE PORN, CHILD PORN) DEFENSE

Child Pornography is a violation of federal and state laws. Production of child pornography, receipt of child pornography, possession of child pornography, distribution or sale of child pornography are computer sex crimes that are prosecuted aggressively. In the past, child pornography was not a highly prosecuted crime. However, due to the increased use of computer technology and the internet, it has become increasingly easier to possess, receive, produce or distribute child pornography. Any actual use of a child in pornographic material is a crime. Both the federal government and the state governments are aggressively prosecuting those who are charged with child pornography. The penalties in federal court for those who are convicted of child pornography are extremely severe.

DUI Maryland Penalties DUID Laws Anne Arundel

DUI In Maryland

Lawyers in Maryland

In Maryland, DUI is a very serious charge, now more than ever. Driving a motor vehicle after consuming alcohol or other drugs may result in being charged with drunk driving. Driving under the influence of alcohol, drunk driving, drinking and driving is commonly referred to as a DUI or DWI. In Maryland, a DUI is the same as a DWI.

DUI Maryland Penalties DUID Laws Anne Arundel
DUI Maryland Penalties DUID Laws Anne Arundel

Another type of offense is a DUID. DUID is driving under the influence of drug(s) or a combination of alcohol and drugs. Regardless of whether you have been charged with a DUI, DWI or DUID in Maryland, the penalties for a DUI conviction are very serious.

The penalties you receive from the court is only the beginning. You stand to lose your job, pay an exorbitant rate for car insurance, lose your ability to drive either completely or have your driving privileges extremely restricted.

The courts have had a lot of pressure put on them lately to not give any kind of break to those charged with an offense where drinking and driving (DUI in Maryland) are involved. These laws apply not only to automobiles, but also to boats and aircraft as well.

The Law Offices of SRIS, P.C. has client meeting locations in Maryland: Rockville, MD. (Montgomery County) & Baltimore, MD.

If you wish to consult with us about a DUI/DWI/DUID case, our attorneys in Maryland can be reached at 888-437-7747.

When the laws against drunk driving (DUI) were originally passed in Maryland, a person was convicted based on a variety of factors such as driving symptoms, field sobriety tests. The drunk driving laws (DUI laws) have evolved considerably and now the standard for determining if a person is driving under the influence is a lot more objective in Maryland. The drunk driving statutes (DUI laws) in Maryland today call for a variety of standardized tests and scientific test to determine if the person who is charged with a DUI in Maryland had a blood alcohol content over the legal limit.

The three main factors the Maryland courts use to determine whether a person is guilty of a DUI in Maryland is the officer’s observations of the accused at the time of offense, field sobriety tests (FSTs) and the intoxilyzer. The current model is the Intox ECR/II. The Intoxilyzer is used to determine a person blood alcohol content (BAC). Through out the entire United States, a BAC of .08% or higher is deemed to be an illegal if driving.

Drinking while driving (DUI) is illegal in Maryland. However, it is only illegal to drive after drinking if your BAC is higher than the legal limit.

If you are under the age of 21 and you drink and drive (DUI) , even a BAC as low as .02% is enough to convict someone of drinking and driving. The blood-alcohol limit for aircraft pilots is 0.04%, and for commercial drivers 0.04% or 0.05%, depending upon the jurisdiction.

At SRIS, P.C., our Maryland attorneys handle DUI cases in Maryland regularly. Our job is to protect your rights. If you’ve been arrested for driving under the influence of alcohol or drugs, please make an appointment with one of our Maryland attorneys regarding your DUI defense in Maryland. Don’t wait until it’s too late to mount a defense. DWI’s and DUI’s are nothing to fool around with. Our Maryland attorneys will do their best to help you.
