Ruther v. State

Facts:

Defendants were convicted in separate circuit court proceedings of first degree assault. The Court of Special Appeals of Maryland affirmed the convictions.  Certiorari was granted and the cases were consolidated.  One defendant contended that his first degree assault conviction was to be mitigated to a second degree assault conviction based on the doctrine of imperfect self-defense.  The other defendant similarly argued that her conviction for first degree assault was to be mitigated to second degree assault based on hot-blooded response to adequate provocation. The State of Maryland countered that the availability of the mitigation defenses was not expanded beyond assault with intent to murder.  The state high court found that the mitigation defense of hot-blooded response to adequate provocation as well as the common law doctrine of imperfect self-defense could be applied to mitigate the crime of first degree assault where an assault could supply the malice necessary for felony-murder if the victim died.

Kart v. State

Facts:

Defendant was convicted of driving without a license. Defendant appealed against his conviction and punishment for driving without a license.  The issue before the court of appeals was whether the State was required to prove all three parts of Md. Code Ann., Transp. § 16-101(a) (1977, 2008 Repl. Vol.), as elements of the offense of driving without a license. Defendant argued that the State was required to prove, beyond a reasonable doubt, that (1) he did not have a Maryland driver’s license; (2) he was not expressly exempt from the licensing requirements; and (3) he was not specifically authorized to drive vehicles of the class that he was driving.  The court of appeals held that § 16-101(a)(1) defined the offense, and § 16-101(a)(2) and (a)(3) were not so incorporated into the offense as to constitute part of it. The exceptions outlined in the latter two parts were affirmative defenses that a defendant must raise. Because defendant railed to raise those affirmative defenses and the State’s evidence was sufficient to support his conviction, defendant was not entitled to relief.

The Court of Special Appeals (Maryland) affirmed. Defendant’s petition for certiorari was granted.

  • Md. Code Ann., Transp. § 16-117.1 (2009), an expungement provision, when read in harmony with Md. Code Ann., Transp. § 12-111(b)(2) (2009), authorizes the Motor Vehicle Administration (MVA), after five years, to remove from a licensee’s public driving record any record of drunken driving convictions and probation before judgment dispositions, rendering the records of those convictions and dispositions no longer part of the licensee’s public driving record and therefore not subject to expungement. The MVA properly denies an individual’s application for a driver’s license without an administrative hearing when the applicant’s driver’s license is suspended, revoked, refused, or canceled in another state. That is so even if the MVA, through mistake or oversight, has previously granted the individual a Maryland driver’s license.
