Marker v. State

Facts:

Defendant was stopped before he entered a prison facility and was informed that the state police would perform a “canine sniff” of his vehicle. Although defendant objected and asked to leave the facility, the sniff was performed. As a result, drugs were found.  Defendant had previous conviction for DUI.  The ceased drugs were introduced at defendant’s trial. The court held that absent reasonable, articulable suspicion of criminal activity, it was unreasonable under U.S. Const. amend. IV and Md. Const. Decl. Rts. art. 26 to detain defendant whom, prior to entering the prison, indicated a preference to leave rather than submit to the detention. The detention was an illegal seizure. The court rejected the state’s argument that the detention was permissible under the exception to the search and seizure rule for detaining motorists at checkpoints.

A jury convicted defendant of second-degree assault and violating a peace order, and acquitted him of first-degree assault, arson, threat of arson and two other arson-related offenses. Facts:
